Welcome to the Sunny Days Travel and Events website. By accessing or using our website and services, you agree to be bound by the following Terms and Conditions. If you do not agree with these terms, please do not use our website or services.

2. Services Provided

Sunny Days Travel and Events provides travel planning and booking services, including but not limited to flights, cruises, car and truck Rentals, concert tickets, amusement park tickets, accommodations, vacation packages, group travel, venue planning, destination weddings, honeymoons, and special events. All bookings are subject to availability and the terms and conditions of third-party suppliers.
 

3. Third-Party Suppliers

Sunny Days Travel and Events acts solely as an agent for travel suppliers such as airlines, cruise lines, hotels, tour operators, limo services, and transportation providers. We are not responsible for acts, errors, omissions, delays, cancellations, or failures of these suppliers. Supplier terms, conditions, and policies (including cancellation and refund policies) apply to all bookings.
 

4. Pricing and Payments

Prices are subject to change until full payment is received and confirmed. Deposits and final payments may be non-refundable depending on supplier policies. By making a payment, you authorize Sunny Days Travel and Events to process payments on your behalf.
 

Upon completion and submission of a Credit Card Authorization Form to Sunny Days Travel and Events, the signed form shall serve as written authorization and a legally binding document. By signing and submitting the form, the cardholder expressly authorizes Sunny Days Travel and Events to charge the specified credit card for the agreed-upon travel and/or event-related purchase(s), including deposits, final payments, service fees, change fees, cancellation penalties, and any additional charges authorized by the client.

Sunny Days Travel and Events does not retain ownership of, nor claim any legal interest in, the credit card. The authorization provided permits use of the card solely for the purchase(s) and services expressly approved by the client.

The cardholder acknowledges and agrees that all payments are subject to the terms and conditions of the respective travel supplier(s), including but not limited to cruise lines, airlines, hotels, tour operators, ticket vendors, and event providers. Cancellation penalties, change fees, and supplier-imposed charges may apply and are the sole responsibility of the client.

By submitting the authorization form, the cardholder agrees not to initiate a chargeback or payment dispute with their financial institution for any charge that is consistent with the authorized purchase(s) and applicable supplier terms and conditions. In the event of an improper or fraudulent chargeback, the cardholder agrees to remain financially responsible for the full amount of the authorized transaction, including any fees, penalties, collection costs, and reasonable attorney’s fees incurred as a result of the dispute.

Sunny Days Travel and Events reserves the right to refuse service in cases of suspected fraud, misuse of payment authorization, or violation of agreed-upon terms. For fraud prevention and verification purposes, additional identification or documentation may be required prior to processing payment.

Third-Party Financing – FlexPay by Upgrade

Sunny Days Travel and Events may offer clients the option to apply for third-party financing through FlexPay by Upgrade for the purpose of funding travel and/or event-related purchase(s). Sunny Days Travel and Events is not a lender, financial institution, or credit provider and is not affiliated with, owned by, or under common control with FlexPay by Upgrade.

Sunny Days Travel and Events serves solely as a facilitator of the application process as a convenience to the client. All credit decisions, loan approvals or denials, interest rates, repayment terms, fees, disclosures, and servicing of the loan are determined exclusively by FlexPay by Upgrade. Sunny Days Travel and Events does not influence or control underwriting decisions, loan terms, approval criteria, repayment obligations, or account management.

Upon loan approval, FlexPay by Upgrade may issue a virtual or physical credit card number for the approved loan amount. By authorizing Sunny Days Travel and Events to use this card number, the client expressly authorizes payment for the agreed-upon travel and/or event purchase(s) in accordance with the approved loan amount.

The client acknowledges and agrees to the following:

• The financing agreement is solely between the client and FlexPay by Upgrade.

• The client is fully responsible for repayment of the loan pursuant to the lender’s terms and conditions, regardless of travel cancellations, supplier changes, or refund status.

• Any disputes related to loan terms, billing statements, interest charges, payment schedules, late fees, credit reporting, or account servicing must be directed to FlexPay by Upgrade.

• Sunny Days Travel and Events bears no responsibility or liability for lending decisions, loan servicing, repayment obligations, or financial disputes arising from the financing agreement.

Refunds and Financing Transactions

In the event a refund is requested and/or granted by a travel supplier (including but not limited to cruise lines, airlines, hotels, tour operators, ticket vendors, or event providers), any approved refund will be returned to the original form of payment in accordance with supplier policies.

For purchases made using financing through FlexPay by Upgrade, refunds—if approved by the supplier—will be processed back to the financing card account issued by FlexPay by Upgrade. Sunny Days Travel and Events does not hold, control, or distribute refunded loan proceeds and is not responsible for issuing, expediting, or guaranteeing the timing of any refund.

Once the supplier releases funds, the refund is processed by FlexPay by Upgrade in accordance with their internal policies and loan agreement terms. The client remains responsible for communicating directly with FlexPay by Upgrade regarding how refunded amounts are applied to their loan balance, account status, or repayment schedule.

Sunny Days Travel and Events shall not be liable for delays, processing timelines, lender policies, or the application of refunded funds to any financing account.

5. Cancellations, Changes, and Refunds

Cancellations, changes, and refunds are governed by the policies of the travel supplier. Sunny Days Travel and Events does not guarantee refunds and is not responsible for penalties imposed by suppliers. Service fees charged by Sunny Days Travel and Events are non-refundable unless stated otherwise.
 

6. Travel Documents and Requirements

Clients are responsible for ensuring they have valid travel documents, including passports, visas, vaccinations, and identification. Sunny Days Travel and Events is not responsible for denied boarding, entry, or travel delays due to improper documentation.
 

7. Travel Risks and Responsibility

Travel involves inherent risks, including but not limited to illness, weather conditions, delays, and unforeseen events. By booking through Sunny Days Travel and Events, you acknowledge and accept these risks and agree to release the company from liability to the fullest extent permitted by law.
 

8. Website Use

You agree to use this website for lawful purposes only. You may not misuse, copy, distribute, or attempt to gain unauthorized access to the website or its content.
 

9. Intellectual Property

All content on this website, including text, logos, graphics, and images, is the property of Sunny Days Travel and Events unless otherwise stated and may not be used without prior written permission.
 

10. Limitation of Liability

Sunny Days Travel and Events shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website.
 

11. Indemnification

You agree to indemnify and hold harmless Sunny Days Travel and Events from any claims, damages, or expenses arising from your use of our services or violation of these Terms and Conditions.
 

12. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United States and the state in which Sunny Days Travel and Events operates.
 

13. Changes to Terms

Sunny Days Travel and Events reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of the website constitutes acceptance of any changes.
